摘要

原住民族研究倫理在臺灣的實踐受到《原住民族基本法》第21 條的保障,要求「應諮商並取得原住民族或部落同意或參與」。然而,目前多數關於原住民族研究倫理的討論聚焦在後者,也就是集體同意權,鮮少針對諮商過程進行探究。集體同意權實踐的困難在於第21 條定義「部落集體同意權」為部落會議的多數決,但由於部落會議召開的難度極高,況且並非每個部落都有部落會議,使得集體同意權難以落實。此外,部落在傳統上都有自己的公共事務決議機制,並且因各部落和族群而異。在此背景之下,本文提倡將焦點從同意權轉向諮商,建構一個由部落族人、原住民族知識專家及學者的諮商平台,以利跨文化理解及對話。我們認為諮商平台將有效地幫助部落和學者準備研究的合作關係,而後續的集體同意權也將在充分知情的前提下做出決定。本文透過檢視與花蓮縣豐濱鄉港口部落合作的過程,反省當代臺灣原住民族研究倫理的處境,並借鏡紐西蘭和美國的實作案例,思考如何建置以原住民族為主體的研究諮商平台,為未來的研究倫理提供更理想的實踐模式。

Abstract

While the practice of indigenous research ethics in Taiwan is bound by the Indigenous Peoples Basic Law to consult and obtain community collective consent, most current discussions have focused on the latter. The challenges of collective consent are not only because the article defines ‘consent by indigenous community’ as majority vote of the tribal council, of which meetings are difficult to call, but also that not every indigenous community has a tribal council. Furthermore, indigenous communities traditionally have their own decision-making structure/organization, which varies from community to community, nation to nation. Against this background, we propose to shift the emphasis to the process of consultation and that a consultation platform should be in place, where indigenous community members, indigenous knowledge professionals and academics work together to facilitate cross-cultural understanding and dialogue. Our belief is that consultation platforms will better prepare communities and researchers for collaborative activities, with collective consent based on informed decisions. In this paper we reflect on current indigenous research ethics and practices through our experiences working with the Makota’ay community and scrutinize examples from New Zealand andthe US in order to locate pragmatic tools for building consultation platforms that uphold indigenous sovereignty, worldviews, and values.
